David Cooper has practised in commercial dispute resolution and employment law, both contentious and non-contentious, for almost 40 years. Prior to joining Excello, he spent his entire working career in Birmingham, initially with the large city centre practice where he progressed from trainee to partner, and subsequently as one of two partners in a suburban business and employment law practice focused upon advising executives, managers and small and medium sized businesses.
He now practises from home close to Wolverhampton. Alongside commercial disputes, he has a particular interest in Settlement Agreements, frequently as a first point of employers’ recommended referral as an independent adviser. He was on the winning side of restraint clause disputes in the Court of Appeal in SafetyNet v Coppage and PSM v Whitehouse.
David's Experience
- Acted at short notice for a team of individual employees needing urgent personally tailored advice on technology sector Settlement Agreements in the face of an imminent deadline.
- Acted via engagement upon a “bulk Settlement Agreement” exercise for a large group of higher education employees requested to agree to new terms and conditions of employment, including an amphitheatre address immediately followed by individual advice slots.
- Successfully applied for respondents’ costs orders founded upon strategic warning letters in two employment tribunal actions where claimants had withdrawn discrimination based claims late in the day.
- Acted for minority shareholder in complex financial sector dispute, where carefully focused attention to the majority shareholder’s future disclosure obligations enabled a better than expected mediation outcome.
- Acted for franchisor in successful defence of “class action” claims, by initially securing a crucial third party disclosure order and subsequently initiating strike out application for unreasonable “warehousing” of consolidated action.
