Victoria specialises in both contentious and non-contentious corporate and personal insolvency matters. Her contentious work includes acting for officeholders and litigation funders in pursuing claims under the Insolvency Act 1986 and the Companies Act 2006, such as misfeasance and antecedent transactions and advising on strategy, prospects of success and recoverability.

Victoria’s non-contentious work includes advising in relation to the appointment of insolvency practitioners and the validity of the appointment and acting in respect of asset sales.

Victoria has considerable experience in the alternative finance sector acting for lenders and security trustees where the loan is default, including advising on the validity of security, the appointment of Law of Property Act receivers and the enforcement of guarantees.  She also acts for directors who are being pursued by insolvency practitioners or in relation to personal guarantees and provides advice to individuals and companies in financial difficulty.

Victoria's Experience

  • Acting for an institutional lender in relation to the enforcement of loans in default, including pursuing individuals or companies who have given guarantees and appointing Law of Property Act receivers or administrators, if necessary.
  • Acting for the administrators of a steelwork specialist, including dealing with suppliers and retention of title claims.
  • Acting for the administrators of a chain of healthy food outlets. As the company operated from several sites, there were various property issues to consider.
  • Acting for a director of an insolvent company in relation to several personal guarantees which had been provided and which totalled circa £1m.
  • Acting for the liquidators of a company in pursuing the former directors for repayment of the overdrawn directors’ loan account.
