Mo Afzal qualified as a solicitor with Pinsent and Co (now Pinsent Masons) in Birmingham in 1990. He was subsequently an associate with DAC Beachcroft for 8 years and specialised in defendant professional indemnity for insurers relating to claims against solicitors. Prior to joining Excello Law, Mo had run his own niche law firm for over 20 years. Mo has expertise in two areas:
(1) Commercial Litigation and Dispute Resolution
Mo deals with contractual disputes, claims against directors, fiduciary claims, civil fraud, misfeasance, and professional indemnity including freezing injunctions including in the Commercial Court and has several reported cases.
(2) Regulatory
Mo acts for both law firms and individuals facing SRA investigations and SDT proceedings on all issues including mortgage fraud, account breaches, breach of integrity and dishonesty. He also advises law firms/individuals on interventions, internal regulatory investigations. PC conditions and disputes with insurers concerning PI coverage on regulatory matters.
Mo 's Experience
- Acted for a Company in a dispute between shareholders concerning a Court ordered sale of 50% of the assets worth £4.3 million. We sought Court declarations about certain restrictions in the Articles of Association concerning the registration of the shares and to obtain directions in relation to the directors duties.
- Acted for a sole practitioner facing dishonesty allegations in relation to a ML form. The claim was successfully defended at the SDT and all allegations were dismissed.
- Acted successfully for a Saudi law firm in proceedings in the Commercial Court seeking declaratory relief in relation to both agency and fiduciary duties regarding assets of around £30m of a Saudi deceased held by the Defendants.
- Successfully defended a £4,8 million PI counterclaim against a firm of accountants who sued for their professional fees. The PI claim was struck out on our summary judgment application. The firm then succeeded at trial on their fee claim and obtained costs order of £250,000 in their favour.
- Acted for a Company which successfully defended a breach of trust claim in relation to a commercial lease based on a fraudulent e-mail. The Defendant went into voluntary liquidation once we obtain compelling IT evidence of the fraud before the trial. We then obtained third party cost orders against the directors for litigation misconduct.
Outside of work, Mo is busy with family and his young son. He enjoys watching most sports particularly cricket and playing golf. He is also enjoys travelling and walking in the Peak District and Wales.
