Annabel is dual qualified as a solicitor and insolvency practitioner, providing legal advice on all corporate and personal insolvency matters. Annabel acts for insolvency practitioners who require assistance with the realisation of assets following insolvency events such as administration, liquidation, and bankruptcy.

Annabel can advise on any issues arising from an insolvency event, ranging from antecedent transactions and retention of title claims, to the administration and distribution of an insolvency estate.

Annabel also has extensive experience of advising individuals and companies in financial difficulty and/or dealing with duress creditors, as well as creditors looking to pursue a debtor individual or company, through either bankruptcy or winding up proceedings. Annabel’s experience extends to institutional investors seeking to enforce lending agreements in default.

Annabel's Experience

  • Assisting an institutional lender with the enforcement of a number of personal guarantees as a result of debtor companies defaulting on the agreed payment terms.
  • Acting for liquidators of a company in pursuing the former directors for repayment of the overdrawn directors’ loan account.
  • Successfully applying for and obtaining declarations that a company was properly placed into Members’ Voluntary Liquidation in 2010, and then properly placed into Creditors’ Voluntary Liquidation in 2014, so the client was validly appointed as liquidator of the company in 2014. The application involved producing evidence in relation to the procedure and facts of the company’s MVL and subsequent CVL.
  • Acting for the client as the petitioning creditor who was faced with an application to annul an individual’s bankruptcy order on the grounds that the bankruptcy order should not have been made. The applicant alleged that the debt upon which the bankruptcy order was based was disputed.
  • Providing advice to an individual whose spouse had petitioned for his / her own bankruptcy as a reaction to divorce proceedings.
