Description of service

Debt recovery for businesses up to the value of £100,000.00 in respect of invoices issued for works done, services rendered and/or goods supplied and/or delivered.

 

Letter before action

Claims against companies, LLPs and partnerships £25.00 per letter + VAT

This is irrespective of the amount of the debt claimed and goes by post and email (if an email address is available). The debtor would usually – depending on the instructions received – be requested to discharge the debt within 14 days in default of which they are notified in the letter that further action would be taken including if appropriate the issue of winding up proceedings.

Claims against individuals: the price for each letter of claim will be the amount of statutory late payment compensation in force at the date of the date of the letter + VAT and will be sent by first class post with the prescribed response pack. This gives the individual debtor the required 30 days from receipt of the letter to respond.

These costs apply where your claim is in relation to an unpaid invoice which is not disputed and enforcement action is not needed.

If the other party disputes your claim at any point, we will discuss any further work required and provide you with revised advice about costs if necessary, which could be on a fixed fee (e.g. if a one-off letter is required), or an hourly rate if more extensive work is needed.

Anyone wishing to proceed with a claim should note that:

  • The VAT element of our fee cannot be reclaimed from your debtor – the recoverable costs include any VAT element that is recoverable
  • Interest and compensation may take the debt into a higher banding, with a higher cost.
  • The costs quoted above are not for matters where judgment is required to be entered or enforcement action, such as the bailiff, is needed to collect your debt.

Our fee in respect of issuing proceedings includes:

  • Taking your instructions and a brief review of documentation but not advice as to the merits of your claim
  • Drafting and issuing claim
  • Receiving payment and sending onto you where it is sent to us
  • If payment is not received within 14 or 28 days after issue and service of proceedings  providing you with advice on next steps as per the tables below

Matters usually take between 2 and 4 weeks from the issue and service of proceedings by the Court to receipt of payment from the other side assuming that they pay without the need to obtain judgment, depending on whether or not the debtor files an acknowledgement of the proceedings indicating a wish to defend the proceedings and the time that it takes the Court to process the various stages of the process.  If enforcement action is needed, the matter will take longer to resolve and additional costs and fees as set out below will be incurred by you.

Notes

  • Fees involved in, for example, chasing the Debtor about instalments and accounting to you periodically with instalments will be charged in addition to the fees shown above at the rates currently prevailing for the fee earner dealing with this matter.
  • In event of non-recovery the amount payable is that set out in the “Total” column (or columns added together) and any costs of enforcing the judgment, plus VAT as appropriate, together with any High Court Enforcement Officer or bailiff’s fees, any company search cost, and any other disbursements.
  • The Fees quoted assume service of proceedings by the Court unless otherwise stated.
  • Other enforcement measures are available and we will be happy to discuss these with you and the costs involved
  • It is imperative that you notify us immediately of any payments received by you and the date you received the same BEFORE banking/accepting the same.
  • It is also imperative that you contact us before agreeing any reduction in the claim as interest, costs and late payment compensation will be claimed by us on your behalf.
