Ben specialises in commercial and property litigation and has particular experience in ground rent and service charge recovery in relation to commercial and residential property.

He is an experienced litigator acting on professional negligence claims, landlord and tenant disputes, property disputes, harassment, delivery up of goods proceedings, product liability claims and disputes of a commercial nature. He also has particular experience of advising on complex litigation including fraud proceedings and Proceeds of Crime Act tracing claims.

Ben also provides family law services including divorce, financial arrangements arising out of divorce and private children matters.

Ben qualified as a solicitor advocate in 2011 and is able to represent clients in the higher level courts in England and Wales for civil matters. He has represented clients in the Property Chamber, First Tier and Upper Tribunal and the High Court.

Prior to joining Excello Law, Ben was a partner and Director of Dispute Resolution at Crooks Commercial Solicitors for five years and has also managed his own specialist litigation practice.

Experience

  • Instructed by the Respondent (as advocate) in the reported case of  Fairhold Mercury Ltd v HQ (Block 1) Action Management Ltd [2013] UKUT 487 successfully resisting an appeal by a freeholder from the lower tribunal decision that an RTM Company could still be an RTM company even if it didn’t adopt the model articles or use “RTM” in its name.
  • Instructed as advocate by a defendant who was being sued by an insurance company after it was alleged he had been involved in a fraudulent road traffic accident, which resulted in a number of personal injury claims. At trial, the insurance company’s claim was dismissed and the defendant was awarded his costs on an indemnity basis.
  • Represented a wife whose husband had been convicted of defrauding his employer of millions over a period of 10 years. The employer sought to recover some of its losses under the Proceeds of Crime Act. Ben was successful in securing the wife’s interest in the assets, and thus providing security for her and her son.

Ben has 4 young children, and when not taking them to various clubs, activities and events he enjoys cycling, movies, music, socialising, boxing, martial arts and rugby.
